Tampa Bay Woman Files Lawsuit Over Unwanted Texts from David’s Bridal
A lawsuit has been filed against David’s Bridal after a Tampa Bay area woman began receiving tons of automatic texts from the business, even though she says she’s never shopped there.
According to reports, Cheri Aul got a new phone number last year. Soon after, she says she started receiving automated text messages from David’s Bridal. The lawsuit claims that she received around 50 messages from the wedding attire company from April to September of 2021.
The issue? She says she never gave them permission to do so.
According to court records, Aul would reply “STOP” to a number given by the David’s Bridal website, and even got back a confirmation saying that she was opted out. But the texts apparently kept coming.
She is now getting help from Billy Howard of the The Consumer Protection Firm. Howard spoke with the MJ Morning Show on Thursday, and told the crew that a class action has now been filed.
He claims that the automated texts go against a new Florida law, stating that automated messages must be consented in written form. This law is known as the Florida Telephone Solicitation Act (FTSA). Aul apparently never gave written consent for David’s Bridal to send her text messages.

Fox 13 reports that David’s Bridal has filed a motion to dismiss the lawsuit, claiming that the law is unconstitutional. They also say the previous owner of the phone number did provide written consent, but was unaware of the change of ownership. David’s Bridal lawyers also claim Aul replied “STOP” to a different David’s Bridal number.
A hearing is scheduled for April 22, 2022 in Pinellas County.
